Creator Program Terms & Conditions

These Terms govern your participation in the Nibblify Creator Program (the “Program”). By submitting a Creator application and ticking the agreement box in the Nibblify Partner app, you accept these Terms in full. If you do not agree, do not apply to or participate in the Program.
1. About the Program
The Program lets approved creators promote Nibblify to restaurant owners. Each approved creator receives a unique promo code. When a restaurant signs up for a paid Nibblify subscription using that code, the restaurant receives a discount and the creator earns a commission on the subscription revenue, as described below.
2. Eligibility
- You must be at least 18 years old and legally able to enter into a binding contract.
- You must hold a valid Nibblify account in good standing.
- You must provide accurate, complete information in your application, including any audience, social, or business details requested.
- You must own, or be fully authorised to use, any channels, content, and audiences you use to promote Nibblify.
- Participation is subject to approval at Nibblify’s sole discretion. Nibblify may decline or revoke approval at any time.
3. Promo Codes & Referrals
- On approval you are issued one unique promo code. The code is personal to you and must not be sold, transferred, or shared with other creators.
- A referred restaurant must enter your promo code at sign-up. The code must be redeemed within 14 days of issuance to that restaurant for the referral to qualify.
- A referral is only valid where the restaurant is a genuine, independent third party that has not previously held a Nibblify subscription.
- The discount applied to a referred restaurant’s subscription is set by Nibblify and may differ by plan and billing period (monthly or annual).
4. Commissions
Commissions are earned only on cleared subscription payments actually made by a qualifying referred restaurant.

Commissions are provisional until the corresponding subscription payment has cleared and any refund or chargeback period has passed. Nibblify may reverse, withhold, or adjust any commission arising from a refund, chargeback, cancellation, fraud, or breach of these Terms.
5. Payouts
- The minimum withdrawal amount is USD 20 (or the equivalent), based on your available balance.
- Payouts are made by bank transfer to the account details you provide. You are responsible for the accuracy of your account holder name, bank name, country, account number, and any SWIFT/BIC details.
- Only one payout request may be in progress at a time. A new request cannot be made while another is pending or under review.
- Payout requests are reviewed before processing. Nibblify may request identity or tax verification (KYC) and may delay or decline a payout pending that verification.
- You are solely responsible for any taxes, levies, or duties on amounts you receive, and for declaring them to the relevant authorities. You participate as an independent party, not as an employee or agent of Nibblify.
6. Acceptable Promotion
You must promote Nibblify honestly and lawfully. You must not:
- Use your own code for your own restaurant or coordinate self-referrals or circular referrals.
- Send spam, or use unsolicited bulk messaging, misleading claims, or false urgency.
- Bid on Nibblify trademarks in paid search, impersonate Nibblify, or imply an official or employment relationship.
- Make any promise, guarantee, or representation about Nibblify beyond official Nibblify materials.
- Use bots, fake accounts, incentivised sign-ups, or any deceptive, fraudulent, or manipulative method to generate referrals.
- Engage in any activity that is unlawful or harmful to Nibblify, restaurants, or customers.
7. Suspension & Termination
Nibblify may suspend or terminate your participation, withhold or reverse unpaid commissions, and disable your promo code, at any time and at its sole discretion, including for actual or suspected fraud, abuse, or breach of these Terms. You may leave the Program at any time; commissions already validly earned and above the payout minimum remain payable, subject to these Terms.
8. Changes to the Program
Nibblify may modify, suspend, or discontinue the Program, or change commission rates, discounts, windows, eligibility, or these Terms, at any time. Material changes take effect when posted at this page or otherwise notified in the app. Continued participation after a change means you accept the revised Terms. Changes are not retroactive to commissions already validly earned.
9. Disclaimer & Limitation of Liability
The Program is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Nibblify is not liable for indirect, incidental, or consequential damages, or for lost profits or anticipated earnings, arising from the Program. Nibblify’s total liability relating to the Program is limited to the total commissions validly payable to you in the three months before the event giving rise to the claim.
10. Governing Law
These Terms are governed by the laws of France, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the competent courts of Le Mans, France.
