1. Our Role (Important)
Nibblify Food acts as an intermediary platform connecting users with independent restaurants. The contract for the supply of food is between you and the Restaurant Partner. While we facilitate the transaction, the Restaurant is solely responsible for the preparation, quality, and safety of the food.
2. Account Security & Registration
You agree to provide accurate, current, and complete information during registration.
- Account Protection: You are responsible for maintaining the confidentiality of your account credentials. Our platform utilizes advanced security protocols, but you must notify us immediately of any unauthorized use.
- Eligibility: You must be at least 18 years old to use our services, or use them under the supervision of a parent or guardian.
3. Orders & Payments
- Order Acceptance: All orders are subject to availability. We reserve the right to decline orders to ensure quality control or due to high demand.
- Secure Transactions: Payments are processed through encrypted, PCI-DSS compliant third-party gateways. Nibblify Food does not store your unmasked banking credentials.
- Pricing: Prices include applicable taxes (VAT). Delivery fees and service charges are calculated clearly at checkout before payment.
4. Delivery Policy
We aim to deliver within estimated timeframes; however, delays due to traffic, weather, or force majeure are possible. For the safety of our drivers and customers, please ensure the delivery location is accessible and safe.
5. Cancellation & Refund Policy
- Perishable Goods: Due to the nature of food services, orders cannot be cancelled once the restaurant has begun preparation.
- Issues & Quality: If your order arrives damaged, incorrect, or incomplete, please contact us via the app within 24 hours. We will investigate, and if validated, process a secure refund or credit.
6. Health & Allergy Disclaimer
Customer Responsibility: While Nibblify Food strives to display accurate menu information, it is your responsibility to verify ingredients and disclose any allergies in the order notes.
We strictly require restaurants to adhere to safety standards, but we cannot guarantee a 100% allergen-free environment in partner kitchens. In case of severe allergies, please contact the restaurant directly.
7. User Conduct & Content
Users agree to treat delivery partners and restaurant staff with respect. We reserve the right to suspend accounts that engage in abusive behavior, fraud, or misuse of the platform. By posting reviews, you grant Nibblify Food a license to use and display that content.
8. Intellectual Property
All content, trademarks, logos, and software code on Nibblify Food are the exclusive property of our company and are protected by international copyright laws.
9. Governing Law
These terms are governed by the laws of France. Any disputes arising from these terms shall be resolved in the competent courts of Paris.
